What are the penalties for drunk driving in Florida?

It is unlawful to drive with a blood alcohol level (BAL) of .08% or higher in Florida, but you can also be convicted under § 316.193, F.S. if it can be proven that your normal faculties were impaired.

First DUI Offense

• Up to $1,000 fine (up to $2,000 fine with BAL of .15% or higher or minor in vehicle)
• Up to 1-year license revocation
• Mandatory 50 hours of community service
• Probation – not to exceed one year
• Up to 9 months in jail
• Vehicle impoundment for 10 days
• DUI school
• May be ordered to install Ignition Interlock Device (IID)

Second DUI Offense (within 5 years)

• Up to $2,000 fine (up to $4,000 fine with BAL of .15% or higher or minor in vehicle)
• Minimum 5 years license revocation
• Up to 12 months in jail
• Vehicle impoundment for 30 days
• DUI school
• Installation of Ignition Interlock Device for at least 1 year

Third DUI Offense (more than 10 years from second)

• Fine between $2,000 and $5,000 (not less than $4,000 with BAL of .15% or higher or minor in vehicle)
• Minimum 10 years license revocation
• Up to 12 months in jail
• Vehicle impoundment for 90 days
• DUI school
• Installation of Ignition Interlock Device for at least 2 years
