Florida’s Child Pornography Statutes
Under §847.001(3), child pornography is defined as any image that depicts a minor engaged in sexual conduct. Sexual conduct refers to any type of sexual activity including simulated or actual sexual intercourse, or any act or conduct which simulates or constituted sexual battery.
The following child pornography offenses are prohibited under Florida law:
- Possession
- Distribution
- Transmission
- Manufacturing
The above offenses are covered under Florida Statutes 847.0135, 847.0138, and 827.071, and are third degree felonies, punishable by a term of imprisonment not to exceed 5 years, and a fine not to exceed $5,000. Further, the crimes of computer pornography (F.S. 847.0135), and transmission of child pornography by an electronic device/equipment (F.S. 847.0137) require sex offender registration.
