Burglary & Trespass Laws In Florida

Under §810.02, a person commits burglary by entering a dwelling or structure with the intent of committing an offense therein, or by surreptitiously entering such a building with the intent of committing a crime therein.

In Florida, burglary is a first degree felony, punishable by a term of imprisonment not to exceed life in prison, if during the course of the offense, the offender:

• Commits assault or battery, or
• Uses a weapon during the crime, or
• Uses a motor vehicle to assist in committing the offense and damages the structure, or
• Causes any damage in excess of $1,000.

Burglary is a felony of the second degree if the offender does not commit an assault or battery, and if the offender was not armed, and there was or was not another person in the home or structure, and the offender entered or remained. Second degree felonies are punishable by up to 15 years in prison.

Burglary is a felony of the third degree if the offender does not commit an assault or battery, and they did not use a dangerous weapon, and there was no one in the home or structure at the time the offender entered or remained. Third degree felonies are punishable by up to 5 years in prison.
